General terms and conditions
1. General
The following General Terms and Conditions shall apply to all contracts, deliveries and other services. We hereby expressly object to any deviating provisions of the contractual partner. We shall be entitled at any time to amend or supplement these General Terms and Conditions of Business, including any appendices, with a reasonable period of notice. Orders received prior to this shall be processed in accordance with the old General Terms and Conditions still valid at that time.
2. Offers
Our offers are non-binding. Small deviations and changes compared to our illustrations or descriptions are possible.
3. Payment and Delivery
The purchase is concluded when the full payment of the goods has reached our bank account. The goods remain the property of Be'Ur NATURAL SkinCare GmbH until full payment has been received. After receipt of the full payment, you will receive the order confirmation by email. If you have entered an invalid email address, the order is considered confirmed as soon as we receive it electronically.
The shipping costs, according to the local prices on our website, will be charged in addition to the value of the goods. Special shipping methods requested by our customers will be charged with local surcharge. You will receive the invoice electronically, in exceptional cases by mail. The following payment options are available to you: Prepayment, credit card, bank transfer, Twint and STRIPE.
4. delivery times
Goods/products that are in stock (we are not responsible for transport difficulties) will be shipped as soon as possible, usually within 2 to 5 days. If the goods are not in stock at the time of order, we will try to deliver as soon as possible. If the non-observance of a delivery or service deadline is due to force majeure, labour disputes, unforeseeable obstacles, or other circumstances for which we are not responsible, the deadline will be extended accordingly. In the event of non-compliance with the delivery period for reasons other than those mentioned above, the Buyer shall be entitled to set a reasonable grace period in writing with the threat of refusal and, after its unsuccessful expiry, to withdraw from the contract with regard to the delivery or service included in the contract. If the impossibility of delivery is due to the inability of the manufacturer or our supplier, both we and the purchaser may withdraw from the contract if the agreed delivery date is exceeded by more than 2 weeks. Claims for damages due to delay or impossibility or non-fulfilment, including those that have arisen up to the point of withdrawal from the contract, are excluded. Unless a legal representative has acted with intent or gross negligence.

6. Consequences of revocation
In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return the performance received in whole or in part or only in a deteriorated condition, you may be required to compensate us for the loss in value. This shall not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection – as would have been possible for you in a store, for example. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the goods by not using the goods as your property and refrain from doing anything that would reduce their value. Goods that can be sent by parcel post are to be returned at our risk. You must bear the costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of CHF 200 or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the goods, for us with their receipt.
7. warranty
Be’Ur NATURAL SkinCare GmbH guarantees that the sold goods are free of material and manufacturing defects at the time of transfer of risk. Upon arrival, the customer must immediately inspect the goods for defects and condition. In the case of complaints, the date of purchase must be proven with an invoice. The claimed item must be sent together with a copy of the invoice, sufficiently stamped. We reserve the right to deviations from store and / or brochure images. These deviations as well as customary deviations about colour, quantity or weight are not considered defects and do not trigger warranty claims.
The warranty does not cover normal wear and tear. The warranty expires if the customer changes the delivered goods. During the warranty period Be'Ur NATURAL SkinCare GmbH has the right to repair/replace free of charge. A partial or complete exchange of the article is permissible.
If defects are not repaired or replaced within a reasonable period, the customer is entitled to cancellation of the contract or reduction of the purchase price.
8. liability
Be’Ur NATURAL SkinCare GmbH does not assume liability for delivered goods that have been changed or otherwise manipulated by the buyer or third parties after shipment or collection. We do not assume any liability for damages of any kind caused by an intentional or negligent impairment of the products delivered by us by the customer.
8.1 Compensation
Claims of the customer for damages, e.g. due to non-performance, culpa in contravened, breach of ancillary contractual obligations, consequential damages, damages in tort and other legal grounds are excluded. Claims arising from the Product Liability Act are not affected by this.
8.2 Liability
Be’Ur NATURAL SkinCare GmbH assumes no liability neither for the constant and uninterrupted availability of www.beur.ch nor for technical or electronic errors of the online offer.
9 Retention of title
The goods remain the property of Be’Ur NATURAL SkinCare GmbH until full payment has been received.
10. privacy policy
Based on Article 13 of the Swiss Federal Constitution and the federal data protection regulations (Data Protection Act, DSG), every person has the right to protection of their privacy and protection against misuse of their personal data. We comply with these provisions. Personal data is treated as strictly confidential and is neither sold nor passed on to third parties. In close cooperation with our hosting providers, we strive to protect the databases as well as possible against unauthorized access, loss, misuse or falsification.
Right of access: Customers have the right to view their personal data at any time and to request changes, blocking and deletion of their data.
11. place of jurisdiction
Place of performance and jurisdiction is the registered office of Be'Ur NATURAL SkinCare GmbH. The law of Switzerland applies exclusively.
